Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and IYMP, Inc. ("IYMP," "we," "us") governing your use of the IYMP SMART website, application, signals, alerts, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Risk Disclaimers. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for ensuring your use of the Service complies with the laws of your jurisdiction.

The Service provides educational analysis, signals, and tools for options traders. It does not provide investment advice, and no content within the Service is a recommendation to buy or sell any security. IYMP is not a registered investment adviser or broker-dealer. See our Risk Disclaimers, which are incorporated into these Terms. You are solely responsible for your trading decisions and their outcomes.

You are responsible for safeguarding your account credentials and for all activity under your account. Provide accurate registration information and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

The Service offers a free tier and paid subscription tiers. Paid plans are billed in advance on a recurring monthly basis and renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period; fees already paid are non-refundable except where required by law. New paid subscriptions may include a free trial; you will not be charged if you cancel before the trial ends. We may change prices with reasonable advance notice, effective at your next renewal.

You agree not to: (a) share, resell, scrape, or redistribute signals, alerts, or other Service content; (b) reverse engineer, decompile, or attempt to extract the Service's models, strategies, or source code; (c) use the Service to violate any law or regulation; (d) interfere with the operation or security of the Service; or (e) access the Service through automated means except public interfaces we provide.

The Service, including its software, signal methodology, setup names (such as COIL BREAK, SNAP BACK, FLOW LOCK, and ZONE ESCAPE), branding, and content, is owned by IYMP, Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use while your account is in good standing.

The Service relies on third-party market data, AI providers, and infrastructure. We do not guarantee the availability, accuracy, or timeliness of third-party data, and interruptions may occur.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SIGNALS WILL BE PROFITABLE, ACCURATE, OR TIMELY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IYMP, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOST DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

You may stop using the Service at any time. We may suspend or terminate your access for violation of these Terms or to protect the Service, with notice where practicable. Sections that by their nature should survive termination (including 3, 7, 9, 10, and 12) survive.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. We may update these Terms from time to time; material changes will be notified through the Service or by email, and continued use after changes take effect constitutes acceptance.
